Distribution of Estate Without A Will

Adopted Children

In the state of Texas, adopted children have the legal right to inherit from their adoptive parents, but they do not have the right to inherit from their biological parents. The child becomes the legal child of the adoptive parents. The adopted child has the same legal rights of inheritance as a biological child, including the right to inherit from the adoptive parents and their relatives, just as if they were born to the adoptive parents.

Parents As Beneficiaries

When a person dies intestate in Texas and leaves behind parents but no spouse or descendants, the parents are generally considered the primary heirs under Texas intestate succession laws. If the deceased person has only one surviving parent, that parent inherits the entire estate. If the deceased person has two surviving parents, they will share the estate equally.

Widow or Single

In the state of Texas, if someone passes away as a single person without a valid will, and there are no surviving spouse, children, grandchildren, or other descendants, your property will be split among your parents and/or siblings, depending on who survives you: If both parents are still living, ½ goes to Mother and ½ goes to Father.

Don’t assume that your spouse will get all of your property when you die. If you die intestate (without a will), Texas law will determine your heirs based on close blood relationships. Heirs include all of your children, including those from past relationships. Heirs do not include your significant other, friends, or stepchildren. Your grandchild won’t inherit from you unless the parent (your adult child) dies before you.

A guardianship is a relationship created and monitored by a court that takes away legal rights There are two types of guardians in Texas: (1) Guardian of the Person; and (2) Guardian of the Estate. The guardian is the person responsible for protecting the ward. The ward is the person being protected. The ward may be a minor or an incapacitated adult. In Texas, guardianship is almost always sought for incapacitated adults.👔

Probate

No Last Will

A Will sets forth your intentions as to how your property should be distributed after you die. A will can reduce family conflict and streamline probate, which refers to the court process of distributing property to heirs upon death. Dying intestate is a lengthy and expensive process, with fees and court costs paid from your estate. A will isn’t a way to avoid probate, but it does ensure that your property will pass according to your wishes.
